Purchase of Products

1. 1.1 You place an order on our website by selecting an item(s) and following the instructions

1. 1.2 You will have an opportunity to check and correct any input error in your order up until you click SUBMIT ORDER.

1. 1.3 After you have submitted your order you will receive an acknowledgement e-mail from us. Please note that this is an automated acknowledgment and not acceptance of your order

1. 1..4 We will authorise your debit/credit card payment. Once payment has been authorised and we have determined the availability of stock we will confirm the expected delivery timescale to you. We expect to do this within 72 hours maximum

1. 1.5 Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you a second e-mail which contains the details of your order

1. 1.6 We reserve the right to decline all or part of any order for what so ever reason and should this occur we will e-mail you with these details

1. 1.7 The contract which you, the customer, enters into upon making a purchase from this website, is made with Branches of Bristol Ltd who will have responsibility for fulfilling its commitments to you but we do reserve the right to transfer our obligation and contract to a third party if the need arises. Contact details for the store can be found on our contact page.

1. 1.8 It is recommended that you retain all e-mails relating to your order and contract

Payment & Security

2.1 Once your order is received we will process payment byway of the credit or debit card details you have provided

2.2 We will advise you if your payment details cannot be authorised for any reason

2.3 All prices and charges on this website are quoted in UK pounds and include VAT

2.4 All payments made on our website are processed using a secure connection on the Sagepay Payment Site

2.5 As additional security no credit or debit card details are stored once your order has been processed

Delivery/Collection

3.1 Your confirmation will provide our best estimate of how long you can expect to wait for your goods. On rare occasions we may experience further delays. We will advise you as soon as we are aware of them. However time is not of the essence and we will use reasonable endeavours to deliver on time.

3.2 You will be liable for all risk, loss or damage in respect of the goods from the time of delivery or collection, and you will become the owner of the goods at that time or at the time that we receive payment in full, if later.

3.3 You will be notified of your delivery date by e-mail or telephone. Free delivery, where applicable, is on a day of our choice. Other dates may be available at our standard delivery cost for local deliveries or by quote for other areas.

3.4 All deliveries and collections must be signed for. If you are out when our delivery team arrive, the furniture will be returned to the store. You will then need to contact the store to arrange another delivery. There will be an additional charge for this.

3.5 Before placing an order please check that there is adequate access into your house and that the items of furniture will fit in through the doorways. Suitable access is your responsibility.

3.6 If you fail to notify us about difficult access we may be forced to deposit the items at the nearest possible point of safety. Please do not expect our delivery teams to put themselves at risk. We must abide by health and safety regulations in respect of our personnel at all locations. Please do not ask our staff to remove footwear, as this is in contravention of their health and safety requirements. Our staff deliver to your room of choice, where practical and safely possible, at your invitation and whilst all care will be taken, we do not accept responsibility for any marks or damage done to your property or possessions in the normal course of their delivery duties. Our delivery staff are on your premises at your invitation and at your risk. Some very large and/or heavy items not suitable for carrying upstairs may be delivered only to your ground floor. This decision is at our delivery staff's discretion. 

3.7 All collections made from our store are done so at your own risk. We will ensure the items are placed by your vehicle but from this point you assume ownership provided the goods are fully paid for. Please do not ask our staff to load your vehicle as this is your responsibility, however please do be aware that incorrect lifting or handling of furniture can cause injury.

Cancellations

4.1 You are entitled to a statutory cooling off period beginning on the date you placed your order and ending 7 days after you received the goods. Certain goods are exempt from this cooling off period for example a mattress which has been taken out of the sealed packaging in which it was delivered, and order in items, such as our Chunky Pine or Langford Painted ranges, or items specially made or ordered in for you. If you require clarification of which items are bought to order items then please telephone the store prior to ordering for information.

4.2 You must inform us in writing during the cooling off period that you are cancelling the contract (e-mails are accepted)

4.3 If you have not received the goods at the time of cancellation and we have not processed the goods for delivery we will refund to you all monies paid in the same form of payment used for the purchase, within 30 days of the cancellation being accepted. This excludes made to order and bespoke items if the goods have already begun being manufactured.

4.4 If you have not received the goods at the time of cancellation but we have processed the goods for delivery you must not unpack the goods when they are received by you. The goods must be returned to us as soon as possible in the original delivery packaging. We will refund to you all the monies paid for the goods minus the cost of delivery and collection in the same form of payment used for the purchase, within 30 days of the cancellation being accepted. Delivery and collection cost is £50 per item.

4.5 If you have received the goods at the time of cancellation the goods must be returned to us as soon as possible. We will refund to you all monies paid for the goods minus the cost of delivery and collection in the same form as payment used for the purchase, within 30 days of the cancellation being accepted PROVIDED THAT the goods are returned by you and received by us in the condition that they were in when delivered to you. This means unopened and in the original packaging. At our discretion, where cancellation is not through any fault of ours, we may also deduct a 5% fee towards our costs associated with the payment and refund card fees.

Warranty/Liability

5.1 We warrant that all goods will comply in all material respects with the order, and will be free from material defects on delivery.

5.2 We agree to resolve, free of charge, any breach of the warranties above at our expense. This may include refund for, or replacement of, goods; but if we do this we shall have no further liability, to you, for breach of the warranties.

5.3 If items fail to arrive or are incorrect you must contact us within 2 days of delivery, If you fail to notify us it is assumed the delivery has been completed correctly.

5.4 We have no liability, to you, for any indirect or consequential loss, damage or expense, loss of profits, goodwill, revenue, anticipated savings, use or contracts.

5.5 Our liability, to you, in respect of death or personal injury resulting from our negligence, or that of our personnel acting in the course of their duties, shall not be limited. Other than in those respects our total liability (including for multiple claims), to you, shall not exceed twice the total payments received from you for the goods that form the basis of the claim.

5.6 The exclusions, and limits of liability, set out exclude and limit all of our liability to you to the fullest extent permitted by law for all matters arising in connection with your order and these terms, and the contract formed under them, whether in contract, tort (including negligence other than as set out), for breach of statutory duty or otherwise.

Product Details

6.1 All dimensions are approximate and are provided in good faith

6.2 It is your responsibility to check that the item purchased will fit in the desired location and that it can be delivered into the premises

6.3 Items made from leather, solid wood or wood veneers exhibit variation in tone and grain within the item and between items. This is a natural characteristic and not a fault. Painted items that use natural wood underneath may have knots in the wood and in some houses, depending on heating and humidity, can on some occasions cause "knot bleed". Our manufacturers use knot blocker to prevent this and in the overwhelming majority of cases knot bleed does not occur but in some houses this may still occur and is not a fault and is something that you should consider before purchasing.

6.4 Most items come in protective wrapping or boxing to ensure they reach you in the best possible condition. If you are collecting, we strongly recommend that you leave any transit packaging in place until you have your items home to avoid damage. Some items come with small knobs called transit feet on the bottom of legs to avoid damage during manufacturing, packing and transit. These feet, and any staples or screws used to attach them, should be removed and disposed of as soon as you have them in your house. We cannot be responsible for any damage to your flooring due to these not being removed.

6.5 Natural products expand and contract with atmospheric changes and all items should be protected from extremes of heat and humidity to avoid splitting or warping.

6.6 Do not put hot objects on furniture tops and protect against liquid spillages as they can leave marks

6.7 Daylight can cause colour changes so please move items placed on furniture regularly to avoid marks

Data Protection & Privacy

7.1 Information you provide to us remains confidential. We are committed to protecting your privacy.

7.2 We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. This will include passing information within the Branches network and SagepayPayment system.

7.3 Your information may be used for marketing purposes to advise you of any special offers or promotions. If you do not wish us to send such information, please notify us in writing.

Statutory Rights & Law

8.1 Your statutory rights are not affected

8.2 These terms and conditions shall be governed by and construed by English Law. This is subject to exclusive jurisdiction of the English courts as well as governed by English Law.

Our Rights

9.1 We reserve the right to withdraw from sale any items which are no longer available, may have been incorrectly advertised or for any other stated reason which will be given upon cancelling your order

9.2 Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation of the nature or quality of any goods offered for sale by us.
